Dash cam regulations you should know, when travelling through Europe
Taking your dash cam with you while you are abroad can provide a great safety net in case of an incident or accident. However just as much as the rules of the road differ from country to country, so do the rules for dash cams.
Filming people, their number plates, private buildings or properties without permission can be a violation against data protection and privacy laws, depending on the country you are in.
Unfortunately there are no set EU regulations for this at the moment, instead it is left up to the individual national governments to decide.

Where can you legally use your Mio Combo / MiVue dash cam?
According to recent ADAC and WHICH reports:
If you wish to use a recording as evidence in Bosnia-Herzegovina, Denmark, Finland & France; other incident/accident participants should be informed, before you submit the footage to the authorities.
In Croatia, Italy, Malta, Netherlands, Norway, Belgium, Romania, Poland & Sweden you can use the dash cam for private use only, also the driver must not be distracted by the position of the dash cam and its cables.
In Sweden and Poland the recordings must be regularly overwritten and the dash cam must be easy to remove.
In Serbia, Spain, Czech Republic and Hungary the dash cam recordings should have only a low resolution, unnecessary data should be deleted after five days and protected against access by unauthorised third parties.
Note: In all of above mentioned countries you will need to have consent of every recognisable person in footage before posting online. However in Poland you cannot post videos without people’s consent not even when obscuring their faces or number plates.
In Germany anyone who films a scenic drive only for private purposes will not violate the privacy policy if other people or license plates are being obscured. If you use the dash cam for the purpose of filming others violating traffic laws, you are breaking the law. If you are involved in an incident it is possible to submit dash cam footage as evidence, but be aware that in some cases the footage has worked against the dash cam user due to violating privacy regulations.
In Switzerland it needs to be obvious that those being recorded are being recorded. Recordings must have a legal purpose; they can’t just be for entertainment purpose. It is OK to have that one recording which shows the accident, but documenting the journey before that accident happened recording many people, vehicles, buildings not involved, is against the Swiss ‘principle of proportionality’.
We do advice against using your dash cam in Luxembourg and Portugal it is currently illegal to use your dash cam here.
Using your dash cam recorder in Austria is not allowed. For first-time offenders it can mean a €10,000 fine, for repeat offender it can more than double up to €25,000. Currently there is no law against owning a dash cam in Austria, but you are only allowed to film your own property.
Tip: These regulations are subject to change.
The best advice we can give is to respect other people’s privacy and not to post videos where people can be seen that haven’t given consent to do so.
Please check installation instructions and make sure the dash cam and cables do not block the view of the driver.
